MsFiscallyFit.com you are agreeing to abide by the terms and conditions below. All members are assumed to be Participants and have reviewed and acknowledged the MsFiscallyFit.com disclosures found in the "Just
Because We Have To" section of the web site. We've created these rules and guidelines to protect you and to ensure that being a member of MsFiscallyFit.com is a safe and a pleasant experience for everyone.
The MsFiscallyFit.com Member Agreement ("Agreement"), along with any future notices of additional terms you may accept, documents your acceptance of the
terms and conditions of your membership. To become a member, you must click on the "Submit" button. As a member you must adhere to the terms and conditions. If you breach the Agreement or we learn that
misleading or untrue information was provided by you, we reserve the right to immediately terminate your membership and any services provided to you by MsFiscallyFit.com.This Agreement may be modified
from time to time and all such modifications shall be effective immediately upon posting of the modified agreement. Members agree to review the Agreement periodically for modifications and the continued use of
MsFiscallyFit.com shall be deemed as a participant's acceptance of this Agreement along with any modifications. From time to time, MsFiscallyFit.com may send e-mails to registered members.
Authorization to receive such e-mails is given at time of registration. Any member may terminate receipt of any such e-mails by simply notifying MsFiscallyFit.com via e-mail that they would like to be removed from
the e-mail list. If you choose to submit any content to any public area of MsFiscallyFit.com, you grant us a royalty-free, worldwide, perpetual, irrevocable, sublicensable, non-exclusive right and
license to use in part or in whole, edit, modify, translate, adapt, reproduce, publish, display or incorporate in other works in any form, any media or technology now known or later developed for the full term of any
rights that may exist in such content. You further warrant that all copyright, publicity and related rights are completely and effectively waived at such time. All materials posted on the
MsFiscallyFit.com site and the layout and design of the site are owned solely by MsFiscallyFit.com and are protected by copyrights, trademarks and other intellectual and proprietary rights. All such materials may
be accessed, downloaded and printed by any participant, but is available only for personal non-commercial use. You agree not to publish, distribute, sell broadcast or exploit any of the content in a commercial
manner without written consent from MsFiscallyFit.com. Registering members of MsFiscallyFit.com will be required to provide their name, e-mail address, state, country, zip code, birthday, marital status,
profession and income. Additional optional information such as street address, city, education, employment status, whether you have children, amount of time online, number of times you shop online, types of
investments, investments of interest, health information and any other information we may ask of you may be provided by you if you choose. This collected information helps us learn about you and your needs so we
can better serve you. We collect and store such information on an aggregate basis and utilize the data to improve our site, deliver materials on the site that will enhance your online experience with content and
marketing information that may be of specific interest to you. From time to time, you may be asked to participate in a survey or any other data collection process outside the member registration by
MsFiscallyFit.com and/or an affiliate. Any personal individual information provided by you will be strictly voluntary and only by your choice. Any personal INDIVIDUAL information provided by
you will not be sold to third parties, unless you provide consent. If a third party wishes to access the database, you will be notified of such request. Your personal individual information shall only be
released upon your consent indicated in the form of an "ok to submit" or similar type fashion. You acknowledge and agree that MsFiscallyFit.com may disclose your aggregate member information (such as what
percentage of the members reside in California) to third parties. At anytime you may ask that your personal individual information be deleted from our database by sending e-mail to: infomaster@msfiscallyfit.com and notify us of such request. In some situations, MsFiscallyFit.com may use your
personal individual information to offer you third party services and products, provide information, in the form of bulletins (both electronic and written), newsletters (both electronic and written), e-mails and other
forms of media to personalize your onsite experience and better serve you with specialized materials in accordance with your preferences. In some cases, MsFiscallyFit.com may allow third party access to
our database due to legal regulatory and security requirements. We reserve the right to disclose information, if necessary, to comply with applicable law or regulation, or with a court or administrative order,
with police investigations or if we believe the accounts may be used to commit unlawful acts or violate this Agreement or be harmful to MsFiscallyFit.com, it's employees, it's affiliates or other members.
Additionally, if third parties require access to the database to perform technical support or services, the information will only be available to such third parties on a limited and specific basis as deemed
necessary. You acknowledge and agree that MsFiscallyFit.com may assign, license or otherwise transfer, your personal information in connection with an assignment, sale, joint venture, or other transfer or
disposition of all or a portion of the assets or stock of MsFiscallyFit.com or its affiliates. MSFISCALLYFIT.COM MAKES NO WARRANTY REGARDING ANY PRODUCTS OR SERVICES PURCHASED OR OBTAINED THROUGH
MSFISCALLYFIT.COM OR ANY TRANSACTIONS ENTERED INTO THROUGH THE SITE. This Agreement and the resolution of any disputes shall be governed in all respects by the laws of the State of California, without
giving effects to conflicts in the law of principles. All parties involved shall submit to jurisdiction in California and further agree that any legal action or proceeding that arising under this agreement shall
be brought in a court in Los Angeles, California. If any provision or condition of this agreement is held to be invalid or unenforceable, such provision or condition shall be removed and deemed invalid and all the
remaining provisions or conditions shall be enforced. MsFiscallyFit.com's failure to act or insist upon strict enforcement of any provision or condition of this agreement does not waive our right to act with
respect to any similar or subsequent breaches by you or other Participants. All the provisions and conditions of this agreement shall apply to your use of any third party services or any transactions performed
between you and such third parties. MsFiscallyFit.com shall not be liable for any delay or failure to perform resulting directly or indirectly from any causes beyond our reasonable control. If you
object to any of the provisions or conditions of this Agreement at any time, you should discontinue use of and terminate access to the web site and its services. Please notify us immediately of your termination by
e-mailing us at: infomaster@msfiscallyfit.com This Agreement constitutes the entire and only agreement between MsFiscallyFit.com and the Members and supersedes any and all prior contemporaneous agreement,
representation, warranties, and understandings with respect to MsFiscallyFit.com, the materials, content, information, goods and services provided by and through MsFiscallyFit.com, and the subject matter hereof. |
